MIAMI. (Univision)- Como si el bebé eligiera un lugar donde nacer o un sitio al que sus padres se trasladen.
Tales propuestas han ocurrido en el pasado, y siempre han sido derrotadas, pero el mero acto de proponer una legislación para negar el derecho a la ciudadanía a hijos de inmigrantes indocumentados crea divisiones que este país no necesita.
Eso sin mencionar que es inconstitucional.
El derecho a la ciudadanía por nacimiento está protegido por la décimo cuarta enmienda.Los legisladores republicanos en el Congreso que apoyan la propuesta sostienen que los inmigrantes indocumentados vienen a este país para tener bebés y de esa manera obtener ayuda social.
El copatrocinador del proyecto. Howard “Buck” McKeon, de Santa Clarita, California, dice que la ciudadanía automática es “un incentivo para que la gente venga y rápidamente tenga un bebé”.
“Ya que el bebé es un ciudadano, es más difícil devolver la familia al lugar de donde provino”, alega McKeon.
El representante Gary Miller de Brea, California, otro copatrocinador de leyes contra inmigrantes indocumentados, dice que “ellos vienen aquí, tienen bebés, los niños son elegibles para ir a la escuela, recibir vales de comida y programas sociales. Los contribuyentes norteamericanos pagan por ello”.

Por supuesto no especifican si están hablando de inmigrantes que vienen de Europa, Asia, África o América Latina. Pero es fácil adivinarlo dado que representan a comunidades con números elevados de hispanos.
Debo decir que tomo de manera personal este tipo de propuestas. Durante una buena parte de su vida adulta, mi padre vivió en Estados Unidos sin documentos apropiados.
Mis padres fueron muy trabajadores con fuertes valores y nunca tomaron un centavo del gobierno. Mis dos hermanas y yo somos miembros productivos de nuestra sociedad y contribuimos ampliamente con nuestro país.
Yo sabía muy poco acerca de las circunstancias en las que mi padre perdió su residencia legal, pero conocí los detalles durante el proceso de investigación para mi libro “Soy La Hija de Mi Padre: Una Vida Sin Secretos.” En la obra narro esa parte de su historia.
Los problemas de inmigración de mi padre comenzaron después de que llegara a Estados Unidos en mayo de 1943. En una carta dirigida al Departamento de Guerra, un año después, explicaba que había venido a este país “a continuar las investigaciones rigurosamente científicas en las especificaciones de la sociología, la filosofía y la historia”.
La historia de mi padre
El había conseguido un trabajo con la National Schools, una cadena de escuelas técnicas de Los Ángeles, como escritor y editor de sus publicaciones de psicología.
Sin embargo, se le exigía que antes de reportarse para el trabajo, se registrara ante la junta de reclutamiento local del ejército.
Mi padre contaba en su carta cómo quince días después de haberse registrado, le dieron una clasificación “1-A,” como si hubiera ingresado al país para inscribirse en el ejército de Estados Unidos.
Sus esfuerzos por apelar a esa clasificación fueron en vano y su solicitud de que se le permitiera regresar a su país le fue negada. Creía que el gobierno lo había llevado a una “trampa”.
En diciembre de ese año, volvió a México sin la autorización requerida. Como dato irónico, mientras que a muchos mexicanos indocumentados se les acusa de violar la ley cuando cruzan la frontera hacia los Estados Unidos, a mi padre se le acusó de haber violado la ley por haber cruzado la frontera desde Estados Unidos hacia México, su país de origen.
En el libro doy detalles de la larga lista de explicaciones de mi padre por sus actos, y su lucha de toda la vida para recobrar su estado legal. Lo consiguió finalmente unos años antes de que falleciera.
La nueva propuesta de ley no afectaría a personas como yo. Permitiría la ciudadanía a niños nacidos en Estados Unidos quiénes tienen al menos un padre que está aquí legalmente.
Hay aproximadamente 4 millones de niños que estarían bajo esa categoría. Pero los hijos de padres indocumentados no deberían ser castigados por los problemas legales de sus padres y no todos los inmigrantes indocumentados deben ser acusados de abusar del sistema.
La historia de mi padre demuestra como cada inmigrante indocumentado tiene un juego diferente de circunstancias que lo o la ubican bajo aquella condición.
Tienen que dejar de tratarlos como a invasores criminales y tienen que dejar de atacar a los bebes. Esta no es la manera de mejorar nuestro resquebrajado sistema migratorio.
