Perú anula libertad condicional a terrorista estadounidense Lori Berenson
LIMA. (Reuters)- La justicia de Perú ordenó la captura de la estadounidense Lori Berenson, acusada de colaborar con un grupo terrorista, tras anular el fallo de una jueza que le otorgó su libertad condicional, dijo el miércoles el viceministro de Justicia, Luis Marín.
Berenson, de 40 años, salió en libertad a fines de mayo por un beneficio penitenciario luego de cumplir tres cuartos de su condena de 20 años de prisión por colaborar con el Movimiento Revolucionario Túpac Amaru (MRTA).
“Los jueces han anulado el fallo que otorgaba el beneficio de libertad condicional a Berenson porque no se cumplieron los requisitos de un debido proceso”, dijo a Reuters Marín.
“Ella está con orden de captura y tiene que volver a prisión”, refirió el funcionario.
El abogado de Berenson, su ex pareja sentimental Anibal Apari, dijo a Reuters que desconocía su paradero. “Hasta ahora no he tenido comunicación con Lori (Berenson), donde se encuentre, (para) decirle que esté tranquila”, acotó.
Dos policías ingresaron después a la vivienda donde Berenson dio como domicilio en un distrito de Lima y verificaron que no se encontraba. “No esta aquí”, dijo uno de ellos a numerosos periodistas que había llegado al lugar.
Reportes de la prensa local dijeron que Berenson estaría buscando refugio en la embajada de Estados Unidos en Lima, algo que el primer ministro, Javier Velásquez, afirmó desconocer.
“La decisión del poder judicial es autónoma y se respeta (…) cuando hay un proceso penal y en un país como el nuestro donde nadie puede poner en tela de juicio que aqui no se respeta el debido proceso, la figura del asilo no calza”, dijo Velásquez a periodistas luego de una reunión de gabinete.
POLEMICA LIBERTAD
La decisión de la sala penal especial se produce dos días después de que Berenson presentara su defensa ante este panel de jueces que evaluaba revocar su libertad condicional, solicitada por abogados del Estado, alegando que no se cumplió el debido proceso.
Berenson, ante los jueces, pidió perdón públicamente a Perú por la violencia que generó en el país y afirmó que ya no representa un peligro para la sociedad.
Fuentes judiciales dijeron que la nulidad del fallo que otorgó a Berenson su libertad condicional es temporal, hasta que la jueza que dio el beneficio emita una nueva sentencia, cumpliendo requisitos como la verificación de su domicilio.
“Mientras eso ocurre, Berenson vuelve al penal”, afirmó.
El viceministro peruano de Justicia dijo que en el nuevo fallo sobre el caso Berenson los jueces podrían decidir otra vez otorgar libertad condicional a la guerrillera.
“Es una posibilidad que tiene la juez”, dijo Marín.
“Si otra vez se da el beneficio, nosotros procederemos a insistir para que la sala especial toque el argumento de fondo para anular una sentencia de libertad condicional”, refirió.
Según Marín, el tema de fondo es que no se “computó bien el tiempo que tenía que cumplir Berenson en prisión” al considerar como carcelería efectiva el periódo que ella estudió y trabajó en el penal.
Su puesta en libertad generó polémica y rechazo en varios sectores políticos y la población de Perú, que vivió la violencia de grupos izquierdistas durante las décadas de 1980 y 1990 con atentados y asesinatos casi a diario.
HERIDA ABIERTA
El MRTA y el maoísta Sendero Luminoso fueron los dos grupos rebeldes que pusieron en jaque al Estado peruano a fines del siglo pasado, cuando la violencia dejó al menos 69.000 muertos y desaparecidos, según datos oficiales.
La liberación de la guerrillera estadounidense abrió en Perú una herida que parecía haber cicatrizado en el país.
Berenson residía -junto a su hijo nacido en prisión- en el distritro limeño Miraflores, donde debía cumplir los cinco años restantes de su condena bajo libertad vigilada.
Los residentes de Miraflores, que no olvidan el coche bomba que dejÛ 25 muertos en un atentado de Sendero Luminoso, no quieren a Berenson como vecina y han realizado protestas en la calle para expresar su rechazo.
El Gobierno del presidente Alan GarcÌa planteó en un momento la culminación anticipada de la condena de Berenson, para permitir su expulsión del país y quitarse de encima una situación que podría convertirse en un problema político.
